It is common for people to make annual gifts or $10,000 or more to various family members in an effort to “protect” money from Medicaid or nursing homes. People mistakenly assume that the annual gifts that are excluded from gift taxes also are excluded by the Medicaid program. That incorrect assumption can lead to significant Medicaid gift penalties and a loss of Medicaid eligibility.
