Our Guardianship Practice

A guardianship is a legal process by which a court determines whether an individual lacks the capacity to manage his/her own financial and personal affairs. Typically, the court will require that two doctors conduct an examination and will appoint an attorney to protect the interests of the allegedly incapacitated person.

Based upon the medical reports and the recommendation of an attorney, the court can appoint a guardian to make financial and medical decisions for the incapacitated person. Spouses and children, in that order, are most often appointed as guardians of an incapacitated person.
